The services provided by the Site are available to you only as a paid subscriber. You must pay the monthly subscription fee to maintain access to the service and information on the Site. The subscription service provides access to premium MMA fighting odds and other specified content for a fee. We may make changes to the subscription services we offer, or to the applicable prices for any such services, at any time. Payments are inclusive of sales tax where applicable. You may cancel your subscription at any time; however, there are no refunds for cancellation and you will continue to have access to the service for the remainder of your applicable billing cycle. Payments are non-refundable and there are no refunds or credits for partially used billing periods.
As a user of this Site, you may be asked to register with us and provide private information. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account or password. If you think there are any possible issues regarding the security of your account on the Site, inform us immediately so we may address them accordingly. We reserve all rights to terminate accounts, edit or remove content and cancel orders at our sole discretion.
By use of this Site you irrevocably consent to the application of the laws of North Carolina, without regard to its conflicts of laws provisions, to govern any and all disputes with Us related to these Terms of Service. Subject to the injunctive relief Terms of Service set forth herein, you also irrevocably consent to the exclusive venue of the courts of Mecklenburg County, North Carolina. The arbitration shall be completed within one hundred twenty (120) days of either giving notice or filing a demand to arbitrate with the American Arbitration Association (whichever shall first occur).
The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. The testimony, evidence, ruling and all documentation regarding any arbitration shall be considered confidential information. Neither party may use, disclose, or divulge any such information unless otherwise required by law.
To the fullest extent permitted by applicable law, no arbitration under these Terms of Service shall be joined to an arbitration involving any other party subject to these Terms of Service, whether through class arbitration proceedings or otherwise. You agree to an arbitration on an individual basis. In any dispute, NEITHER YOU NOR WE WILL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER VISITORS IN COURT OR IN ARBITRATION OR OTHERWISE PARTICIPATE IN ANY CLAIM AS A CLASS REPRESENTATIVE, CLASS MEMBER OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. Unless caused by our willful and wanton misconduct, our total liability to you is limited and will not exceed one hundred dollars ($100) or the total amount you paid us during the one (1) month period before you made your claim, whichever is greater. Recovery of these damages will be your sole and exclusive remedy. WE DISCLAIM ANY LIABILITY FOR ANY OTHER DAMAGES OF ANY KIND ARISING OUT OF THESE TERMS OF SERVICE OR YOUR ACCESS TO THE SITE.
